The California Association of Realtors have created four new forms as a result of the current CoronaVirus pandemic. Here is a list of the four new forms and sample copies of them.


CORONAVIRUS ADDENDUM OR AMENDMENT

(C.A.R. Form CVA, 3/20)

This new addendum or amendment allows for both parties to agree to an extension of time or contingencies or a mutual cancellation because of unforeseen issues related to CoronaVirus.

CORONAVIRUS PROPERTY ENTRY ADVISORY AND DECLARATION (Updated May 27, 2020)

Sample Form – CoronaVirus Property Entry Advisory & Declaration

This form is to be used when an agent calls requesting to show a property to a client. It is also recommended that you indicate in showing instructions for agent to submit Form PEAD at time of requesting a showing.

This form also provides for seller to give permission for vendors, inspectors & appraisers access to property to conduct the needed inspections or services needed to market property.


LISTING AGREEMENT CORONAVIRUS ADDENDUM OR AMENDMENT

Sample Form – LISTING AGREEMENT CORONAVIRUS ADDENDUM OR AMENDMENT

The RLA-CAA form is to be used when taking a new listing or if you already have a listing it would be recommended that you add this as an Amendment to existing listing. It updates the seller as to the recommended CAR disclosure affecting the marketing and sale of property.

If added as an amendment go to line 6 and check the box that indicates “This is an amendment to the existing listing agreement……”

You will see that what CAR legal has done is to limit liability to the listing agent and listing brokerage firm by disclosing the risk and challenges to selling a property in current pandemic.

Section 1. “Property Showings”  clarifies that Seller is in agreement OR DOES NOT agree to allow prospective purchasers to enter property……..

It also notifies Seller and seller confirms receipt of Form PEAD by Seller.


NOTICE OF UNFORESEEN CORONAVIRUS CIRCUMSTANCES

Sample Form – Notice of Unforeseen Coronavirus Circumstances

This form can be used to let the other party know that unforeseen CoronaVirus circumstances have taken place that has effected the ability of one of the parties to move forward. It calls for for an extension of time or mutual cancellation.

Sample Form – Posted Rules for Entry

Rules for entry all parties must agree to before entering a property. To be provided by listing agent with the PEAD-V forms which must be signed prior to entering property.
